This website is provided “as is” without any representations or warranties, express or implied.  Vaporlane makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Vaporlane does not warrant that:

Nothing on this website constitutes, or is meant to constitute, advice of any kind.  If you require advice in relation to any legal, financial or medical matter you should consult an appropriate professional.

Vaporlane will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Vaporlane has been expressly advised of the potential loss.

Exceptions.

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Vaporlane’s liability in respect of any:

death or personal injury caused by Vaporlane negligence;

fraud or fraudulent misrepresentation on the part of Vaporlane; or

matter which it would be illegal or unlawful for Vaporlane to exclude or limit, or to attempt or purport to exclude or limit, its liability.

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

Other parties.

You accept that, as a limited liability entity, Vaporlane has an interest in limiting the personal liability of its officers and employees.  You agree that you will not bring any claim personally against Vaporlane’s officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Vaporlane’s officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Vaporlane.

Unenforceable provisions.

If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Indemnity.

You hereby indemnify Vaporlane and undertake to keep Vaporlane indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Vaporlane to a third party in settlement of a claim or dispute on the advice of Vaporlane legal advisers) incurred or suffered by Vaporlane arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Ordering.

All orders for goods will be deemed an offer by you to purchase goods pursuant to these terms and conditions and are subject to acceptance by Vaporlane. Vaporlane may choose not to accept an order for any reason.

By purchasing, you agree that all details provided to Vaporlane are correct, that the credit or debit card being used is owned by you, and that there are sufficient funds to cover the cost of the goods ordered.

In the event where the goods ordered by you are not available from Vaporlane stock, you will be notified by email or phone and given the option to either wait until the goods are available from stock or cancel the order and receive a full refund within 30 days.

Once your order has been placed and completed online you will be sent an automated e-mail confirmation of the order. Any delays in processing times and/or stock updates will be advised after this email confirmation.

All Vaporlane PRE-ORDER sales and offers are final. By entering a PRE-ORDER arrangement, you agree to immediate payment for the PRE-ORDER status and no credit/refund will be offered outside of the Vaporlane Warranty and Return Policy.

Vaporlane may cancel an order at any time and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time without notice. If an order is cancelled, any payment made for the goods will be refunded in full.

Pricing and payment.

The price of the goods shall be that which is stated on the Vaporlane website or via legitimate Vaporlane promotion including social media platforms.

Any pricing errors will result in your order being suspended until which time we can contact you via your preferred contact method. In the instance that Vaporlane cannot contact you, Vaporlane will render the order cancelled and the amount received from you pertaining to the order will be refunded by the same manner in which it was paid.

All orders must be paid for in full before any goods will be delivered. All products are subject to availability and remain the property of Vaporlane until paid for in full.

All individual prices listed on the Vaporlane website are EXCLUSIVE of GST unless otherwise specified. GST is added to the total order of goods if applicable.

Delivery.

Vaporlane aims to process and arrange delivery for a standard order within 48hrs of the automatic email order confirmation. Orders requesting express postage will be treated with priority and dispatched within 24 hours of receiving the automatic email order confirmation. Vaporlane does not hold responsibility for delays in delivery through Australia Post or relevant delivery services.

Orders are delivered as soon as possible.The terms of delivery mentioned our site site are only an indication and do not count as final. Vaporlane can put additional information concerning these terms of delivery on the internet site or make this information known in another written way. This information is only meant as an indication.

If a product is ordered by the purchaser is momentarily out of stock, information will be given about the availability. The purchaser will be informed of the delay by e-mail or by telephone.

Deliveries will be made to the address indicated by the purchaser at the conclusion of the agreement.

Vaporlane will organise the delivery by mail or by any other means to be chosen by Vaporlane, for the account of the purchaser. Delivery by mail or in any other way will take place after the receipt of the payment for the products by Vaporlane. The ownership is handed over at the delivery itself. Damaged goods will not be warranted by Vaporlane. Claims will need to be made with Australia Post or relevant delivery service directly

and by the purchaser.

Delivery will be made at risk of the client. Vaporlane can not be held responsible for local restrictions because of legislation.

Delivery will be arranged as soon as the entire payment has been received from the purchaser.

Vaporlane cannot be held responsible for damage or loss to the goods during shipping. Vaporlane will not be held responsible for detained packages and the purchaser will need to contact Australia Post as Vaporlane will not warrant any damage in the shipping process.

Breaches of these Terms and Conditions.

Without prejudice to Vaporlane’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Vaporlane may take such action as Vaporlane deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation.

Vaporlane may revise these terms and conditions from time-to-time.  Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website.  Please check this page regularly to ensure you are familiar with the current version.

Assignment.

Vaporlane may transfer, sub-contract or otherwise deal with Vaporlane’s rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability.

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.  If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement.

These terms and conditions, together with the Privacy Policy, Shipping Policy and Returns Policy, constitute the entire agreement between you and Vaporlane in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
